Tier 1 Companies
Companies that want to be categorized under the Tier 1 classification must have a 100% commitment to the WPS, worker’s rights protection, and comply with policies that promote diversity in the country. Moreover, they have to comply with the regulations of the labour market set forth by the UAE.
Furthermore, they have to meet the additional criteria:
- Promote cultural diversity by being one of the training and employment centers that engage in this action.
- Cooperate with the Nafis program to train at least 500 individuals per year.
- Have an Emiratisation rate of at least three times above the target.
- Being a company owned by a young citizen (as per the approved standards).
- Being active in specified sectors and activities as per the Council of Ministers.
Tier 2 Companies
Companies that belong to the Tier 2 are those that do not meet the additional criteria of Tier 1. Corporations need to commit to the WPS, workers’ rights protection, and comply with policies that encourage diversity in both culture and demography in the workforce. In addition, they have to comply with the regulations of the labour market.
So, although they do not comply with the additional criteria, if they have an extent of compliance with the previous aspects, they can get the Tier 2 classification.
Tier 3 Companies
The Tier 3 of the new classification system for the private sector is not so good for the company’s reputation. This is because corporations that have this classification will be known as those that do not comply with the law.
Moreover, job seekers should look for a job in Tier 1 and 2 companies. Thus, Tier 3 Companies will find it harder to hire employees.
Corporations that will be classified under this category are the following:
- Companies found violating the law. If companies do not follow labour and executive regulations, as well as resolutions for the labour market, will be classified as Tier 3. Moreover, those that do not protect workers’ rights will be classified too.
- Corporations that lack the commitment to encourage cultural diversity in the workforce and the labour market.
- Companies that incur any other violation of the Ministerial Resolution No. 209 of 2022. These can be human trafficking, having employees without respective job permits, providing incorrect data, documentation, or information to the Authority, incur in violations of obligations on wages, not complying with housing and safety standards, fake Emiratisation practices, or any other.
